This website is owned and operated by Peoples Times Limited a registered company of New Zealand trading as the People’s Times (“we, us, our”).

Your use of this website is subject to these terms of use and all applicable laws. By using this website you agree to be bound by these terms of use.

We reserve the right to modify, alter or amend these terms of use from time to time with or without notice to you. All such amendments will be effective immediately upon such an update being made. By continuing to use this website following an update you agree to be bound by the amended terms of use.

1. Exclusions and limitation of liability

We will not be liable for any damage, loss, cost, claim or expense arising out of or relating to

  • Any product or service purchased via this website; or

  • Your use of this website; or

  • Your use of or reliance on information contained or accessed through this website; or

  • Any breach of your warranties stated in these terms of use

and to the extent allowed by law we exclude all warranties not expressly stated in these terms of use.

We exclude all liability we or any of our suppliers, licensors, related companies, agents, officers, and employees may have to you to the maximum extent permitted by law. This exclusion applies whatever you are claiming for and in whatever way liability might arise if it were not for this clause (including in tort, contract and equity or under statute).

We are not an agent of or representative for any wholesaler, retailer, supplier of services or any other third party who utilise or contribute to this website (“third party”).  We are not responsible for any transactions you may enter into with such third party via your use of this website, your participation in any promotions or as a result of any dealings between you and any third party arising from your use of this website. To the fullest extent permitted by law, we exclude any liability for and disclaim any responsibility related to any products and services you purchase and/or dealings you may have with any such third party and which you become aware of through or via this website. In such instance any questions, complaints or claims you may have should be directed to the appropriate third party.

We are not responsible for ensuring that the information that you access or make available through using this website will be private or secure or free from viruses or other harmful things. We do not and cannot guarantee availability of this website and our services or that there will be no interruptions or delays in relation to this website or our services. This is because the availability or quality of this website may be affected by conditions beyond our control, including, for example, but not limited to network problems, human or technical error, atmospheric, geographic, or topographic conditions.

We are not responsible to you, or anyone else for any information that does not originate directly from us, any links we provide to third party web sites or information at or accessible from those web sites or any loss or damage arising from your use of this website. Further, we assume no responsibility for the corruption of any data or information held by us.

These terms of use do not affect any statutory rights you may have under New Zealand law

2. Governing law

These terms of use and the provision of goods and services by us are governed by and to be interpreted in accordance with the laws in force in New Zealand and in the event of any dispute arising in relation to these terms of use or their subject matter you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New Zealand over such dispute.

3. Membership

In consideration of your use of this website you agree to register as a member and to provide information as prompted by our membership process and that all of the information you give us is at all times true, correct, up to date and complete.

We reserve the right to decline to register or to terminate your membership without entering into further discussions with you. We may terminate your membership if a serious complaint or multiple complaints are received about you from other members, if you breach these terms and conditions, if you impersonate another member, or if we, at our sole discretion, deem your behaviour to be unacceptable. Members who have registered under multiple aliases will have all their aliases disabled.

4. Your conduct and use of this website

You agree to;

  • Follow our instructions when you use any services advertised on this website.

  • Not use this website inappropriately or unreasonably, e.g. send spam, abusive or defamatory e-mails, interfere with anyone’s rights, post or contribute to this website any offensive, unlawful, harmful, actionable, abusive, harassing, obscene, objectionable or otherwise actionable material, collect information about others, create a false identity or transmit or upload any material which breaches our or any third party’s rights, any applicable laws or is likely to do so.

  • Use this website and any products or services purchased by you through this website only for lawful purposes.

  • Ensure that all persons you are responsible for also meet these commitments and your other obligations under these terms of use.

  • Meet any costs we incur protecting ourselves against any legal action or which we otherwise incur as a result of your use of this website and the purchase by you of any products or services via this website.

  • Not use any information available on this website for any commercial purpose other than for the purchase by you of products or services advertised on it.

  • Not to copy, alter or tamper with any material or contributions contained in or on this website.

5. Intellectual property

We own all proprietary and intellectual property rights in and to this website, the Peoples Times and the contributions and material displayed here, except for:

  • content you post on this website and licence to us (see clause 6);
  • content clearly labelled as sourced from third-party publishers and individuals, which is and remains their intellectual property, and is displayed by us solely for the purpose of linking you to items of interest on external sites. Your use of such content is governed by the terms and conditions specified on the third-party site from which it originates; and
  • Getty Images Content, which is wholly owned by Getty Images (or its licensors and third-party image partners) and displayed by us under license. (Getty Images retains and reserves all rights, title, and interest in and to its Licensed Material. You may not download Getty's Licensed Material for other than personal use, and republication, retransmission, reproduction, or other use of the Licensed Material is prohibited under New Zealand and international law.)

You may not upload to, or copy any material from, the People's Times unless you have the right or consent to do so.

6. Contributions to this website

The following terms and conditions apply to and are relied on by us in relation to all contributions, advertisements, public notices, comments, photos and/or other material (“contributions”) we accept for posting or are uploaded on this website, except where we agree otherwise in writing. All contributions made are subject to your agreement to these terms and conditions. By posting a contribution you acknowledge and agree to such terms and conditions.

By posting a contribution on the site you acknowledge that your contribution is unedited by us. As a result we can in no way endorse any contribution or be held responsible for inaccuracies in content.

You acknowledge and agree that any contributions posted by you will not contain inappropriate language or defamatory statements or comments attacking the personal character of another person. You further agree to not post contributions for the purposes of advertising, promoting your business or soliciting others unless expressly permitted to do so by us. This includes but is not limited to using the website to create or distribute chain letters, junk mail or spam mail.

By allowing your contributions to be uploaded or posted on this website we are doing so in consideration of the fact that you understand that all contributions are the sole responsibility of the person from which such contributions originated and that, therefore, you are solely responsible for all contributions that you chose to upload or post on our website and that you must evaluate your own contribution and in particular we are relying on your express warranty that:

    • is misleading or deceptive or likely to mislead or deceive or which otherwise breaches the Fair Trading Act 1986; or

  • Your contribution will not give rise to any liability on our part or in a claim being made against us; and

  • You agree to take full legal responsibility and liability for any adverse legal or other consequences arising from your contribution (including but not limited to liability for offensive or defamatory statements) and in doing so you agree to fully indemnify us against any or all costs incurred by us or any damages suffered by us as a result of your contribution being in breach of these terms of use.

By posting or uploading your contribution on this website you grant us a perpetual, royalty free licence to reproduce, modify, adapt, publish, translate, create derivative works from, distribute, disseminate, perform, transmit and display such contribution (in whole or part) and/or to incorporate it in other works in any form, media or technology now known or later developed for the full term of any rights that may exist in such content.

You acknowledge and agree that any contribution posted by you on the website will be licensed under the Creative Commons Attribution-Share Alike New Zealand Licence (“BY-SA licence”). The BY-SA licence will allow third parties to alter your contribution for both non-commercial and commercial purposes as long as they credit you for the original work. Where links to any third party websites are provided they are provided for convenience only and do not imply any endorsement approval or recommendation of or responsibility for the contents, products, services or operations of those sites or the operators of those websites. We accept no responsibility for any damage or harm from your use or reliance on the information contained in those websites.

You may only create links from the People’s Times to external websites where you are entitled to do so and where the creation of the link doesn’t otherwise breach these terms.

8. Electronic communications

Whenever you use this website or send emails to us you are communicating with us electronically. This means you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the People’s Times. You agree that all agreements, notices, disclosures and other communications that we provide to electronically satisfy any legal requirements that such communications be in writing. 9. Privacy policy

You will provide us with personal information through your use of this website. This information will be retained by us in our database and will not be accessible or released to any third parties except in circumstances where we are required to do so by law. You have a right under the Privacy Act 1993 to access any personal information held about you or to request us to delete any such information (please review our Privacy Policy)

10. General

We may transfer our obligations pursuant to this website and these terms of use to any person including a related company (as defined under the Companies Act 1993) without notice to you. If we do this then we will not be liable for any act or omission by any transferee arising in relation to these terms of use after such transfer.

Each term of these terms of use is separately binding. If for any reason any term cannot be relied on all other terms remain binding.
